What Are the Grounds for a Divorce in Fair Lawn?

New Jersey recognizes two distinct types of divorces: no-fault and fault.

There are no grounds for a no-fault divorce. The only requirement is that the spouses are separated for at least 18 months prior to filing for a dissolution of their marriage. In essence, the spouses agree that no one is to blame for the split. Rather, the marriage just didn’t work.

On the other hand, a spouse can request a fault-based divorce, which does not have a legal separation requirement.

The grounds on which a fault-based divorce can be sought in Fair Lawn include:

  • Adultery
  • Deviant sexual conduct
  • Extreme cruelty
  • Domestic violence
  • Desertion
  • Voluntary addiction
  • Habitual drunkenness
  • Incarceration
  • Institutionalization for a mental illness

If you file a divorce based on one of these grounds, you’ll need to have evidence to prove your case. A judge will only grant your dissolution if you can demonstrate your spouse’s misconduct by a preponderance of the evidence. Ultimately, a judge has to be convinced that your side of the story is more likely true than not.

Does New Jersey Have Divorce Residency Requirements?

You or your spouse must have lived in the State of New Jersey for at least one consecutive year before filing for a divorce. If you don’t satisfy the residency requirement, you’ll have to hold off on filing your complaint until you or your spouse have been in the Garden State for at least 12 months.

How Long Will It Take for My Divorce To Be Finalized?

Divorce is a legal process. It can take time. How long the process lasts will depend on several factors.

  • Are you seeking a fault-based or no-fault divorce?
  • Is the divorce uncontested?
  • If contested, how many aspects of your divorce are in dispute?

When you file for a fault-based divorce, you have to demonstrate that the grounds on which the dissolution is sought have existed for at least six months. If your divorce is uncontested, it can be resolved in a matter of weeks. If your spouse contests the divorce or if you disagree about any of the terms of the dissolution, the process will take longer. All aspects of your divorce must be settled before a judge will approve the split.

The same holds true for a no-fault divorce, except that the process is naturally extended due to the 18-month separation requirement. However, if you and your spouse are in agreement on the divorce, you can spend those 18 months firming up the details of your split so that it takes less time (and costs less money) once you’re able to file.

We Can Help You Navigate All Aspects of Your Fair Lawn Divorce

Divorce is complicated, in part, because there are many issues that have to be resolved before the dissolution can be finalized.

At Arons & Solomon Divorce Lawyers, our divorce lawyers in Fair Lawn have over 150 years of combined experience helping clients have difficult conversations and negotiate terms in complex divorce cases.

This includes:

Child Custody

Divorce doesn’t just affect adults. If parents decide to split up, it has a huge impact on their kids, too. Our child custody attorneys in Fair Lawn want to help you find a custody arrangement that serves your child’s best interests. We’ll help you and your spouse work to put aside your differences, find common ground, and resolve physical and legal custody issues.

Child Support

Just because parents get divorced doesn’t mean financial obligations to support their children disappear. Many times, the custodial parent – the parent with whom the children spend most of their time – can receive child support payments to help cover housing costs, food, education, medical care, and other needs. Our Fair Lawn child support attorneys will help you advocate to get the best financial support for your children possible.

Alimony

Alimony – or spousal support – isn’t automatic in New Jersey. You can request to receive financial support from your spouse after your divorce, but the state will weigh many factors when determining if it should be awarded and for how long.

Our alimony divorce attorneys in Fair Lawn can help you advocate for spousal support payments or contest your spouse’s request for support. We’ll gather evidence and build a compelling case that highlights the law and serves your best interests.

Property Division

In some states, spouses are entitled to half of all marital assets upon a divorce. That’s not the case in New Jersey. In Fair Lawn, property division is done equitably. Each spouse is entitled to their fair share of the marital property and debts, which may or may not be right down the middle.

Property division laws won’t apply when you have a prenuptial agreement or postnuptial agreement in place.

Property division is an art and a science – especially in high net worth cases. Our Fair Lawn property division attorneys will help you identify the assets you’re more interested in keeping, determine which ones can be sold off for profit, and pick the property you’re okay with giving up entirely. We’ll enlist experts to help us value your assets and debts and construct a proposal that sets you up for the future.
