Divorce rarely enters the thoughts of most folks who are contemplating marriage. But it is something that you should consider in advance of the day you make that important commitment to another person.  Even if you do not have any assets or a significant income now, during your marriage you may accumulate assets and earn more. A prenuptial agreement (“prenup”) is a way to address, among other things, the issues of support and division of marital assets before you say, “I do,” that can offer a number of benefits.  Here’s why:

  1. Opening the lines of communication. Some folks take the position that they do not want to raise the issue of divorce because it is bad luck or it isn’t romantic or it may frighten the other party away. However, discussing the idea of having a prenup and then negotiating its terms affords both parties the opportunity to be forthright and honest about important issues in advance of the marriage.  Approached in a positive manner, it can actually be used as a vehicle for both parties to become more open and honest with one another.
  2. Divorce may be less stressful and costly. Should divorce be unavoidable, the terms set forth in the prenup will address many of the issues which need to be resolved when a marriage ends. Those include, but are not limited to, division of the marital assets and spousal support, thus reducing the usual argument and stress of the divorce process.
  3. Future is protected. Before you marry, it is important for you and your spouse-to-be to discuss big issues, such as your positions on alimony, whether either of you will be a stay-at-home parent, or if you both work outside the home, how will you divide the payment of the family’s expenses, etc. A prenup stimulates the discussion and helps you set a plan for the future. Having a prenup in place may afford the emotional and financial protection—both of you are seeking.
